A Ranking of BN’s Twelve Worse Political Disasters

Barisan Nasional is a natural magnet for scandals and self-inflicted public relation disasters, mainly due to its entrenched patronage politics (an euphemism for corruption) and its contempt for the public. The following is a ranking of one dozen worse political disasters which will drag BN down at the 13th general election in order of least to heaviest impact. This “dirty dozen” are selected on the basis of their deep effect on a wide segment of the population and the durability of their impact to last till the next election.
No. 12 – Death in Custody of Ananthan Kugan
At this level there are many competing scandals such as the theft of jet engines from the air force, the RM540 million commission paid for submarines and pointless ISA detentions of Teresa Kok and Sin Chew journalist Tan but none have the emotional impact of the death in custody of A. Kugan who was arrested as a suspected car thief in Jan 2009
A government pathologist performed an autopsy and proclaimed that he died of water in his lungs. Dissatisfied, his family members demanded another autopsy which revealed that Kugan died of horrific beatings and torture which caused his kidneys to fail. After a long delay of 9 months and much public pressure, a lowly Indian police constable was charged with causing grievous hurt although the victim died and there were suspicions of others involved. Can you say scapegoat?
Kugan will not be the last to die in custody but he is the most widely publicized and has become the poster boy of the numerous helpless victims who die with shocking regularity in the hands of our law enforcement agencies.
No. 11 – Shah Alam Cow Head Protest
Race and religious baiting is nothing new with a party which leverages on racial and religious tension to maintain its power. In this category are Ahmad Ismail’s and Nasir Safar’s racist outbursts. The Umno controlled Utusan Malaysia frequently goes on a racist rant without any fear of sedition laws.
But come next election, Ahmad Ismail and Nasir Safar will be largely forgotten. The event which sears itself into the minds of voters is the cow head protest held at the Selangor State Secretariat over the relocation of a Hindu temple to Section 23 in Shah Alam. To drive home the insult the protesters which were widely perceived to be linked to Umno brought along a severed cow head, an animal which is sacred to Hindus.
This wasn’t the most damaging act. What really disappointed the people was the police inaction during the protest although they have been known to be brutally effective in dealing with any anti-BN protests. To compound the damage to BN, Home Minister Hisahmuddin granted a meeting with the protesters and even defended their action. Although some of the protesters were charged for sedition the delay has earned the public’s ire and gave the impression that the religious sensitivities of minorities are secondary under the BN regime.
No. 10 – Refusal to Charge Al-Islam Journalists
Two journalists from the Utusan Malaysia offshoot Al-Islam entered a Catholic church to spy on the activities just in case the church is secretly converting Muslim teenagers. They took part in the holy communion but spat out and photographed the white bread which Catholics believe is changed to the body of Christ. Then they had the audacity to write about it.
Despite this highly sacrilegious act which is an insult to the Catholic religion the Attorney-General refused to charge them on the specious reasons that they were ignorant, no public disorder had been caused and it would not serve the interest of justice. One wonders whether such forbearance would be shown if a sacrilegious had been made against Islam. The magazine later apologized but the apology was 10 months late and only offered under public pressure.
At about the same time, The Star was slapped a show cause letter for a reasonable, rational and cautious article questioning the caning of three Muslim women on the basis that it had insulted Islam. The BN government’s double standard is clear. Minorities can expect little or no protection for any attacks and insults on their race and religion while it goes overboard to protect the dominant race and religion.
No. 9 – Refusal to Charge VK Lingam
The Lingam video affair rocked the nation with its expose of corruption and undue influence in judicial appointments. Due to intense public pressure a Royal Commission of Inquiry was appointed to probe the case and concluded that the incriminating video was genuine and there was unseemly interaction between Lingam and the ex-Chief Justice, Tun Eusoffe Chin in a New Zealand holiday.
The RCI recommended criminal action against the main actor Lingam and a few others. To date the Attorney-General has shown amazing reluctance to charge anybody over this documented proof of judicial interference while it goes after dubious transgressions against opposition leaders such as Karpal Singh’s sedition charge.
The judiciary is the pillar of a modern democracy and to restore its reputation is of paramount importance. Does the refusal to charge VK Lingam indicate the lack of political will to correct the rot in our democratic institutions? Correct! Correct! Correct!
No. 8 – The Altantuya Affair
The violent murder of a Mongolian girl whose body was blown up by explosives scandalized the nation with its audacity and rumours of high level involvement. A string of revelations by Raja Petra Kamaruddin and private investigator Balasubramaniam told a salacious tale of a Mongolian beauty, extra-marital affairs, meetings in Paris, secret commission on a submarine deal, jilted lover, blackmail, murder and allegations of VIP involvement including Najib Razak himself.
P.I. Bala made a damning statutory declaration but in an amazing turn-around, he retracted it the next day and disappeared. He resurfaced more than a year later with more riveting tales of how he had been offered RM5 million and forced to flee to India via Singapore and Bangkok. A long-winded trial ended in the conviction of two police commandos for her death and the acquittal of Najib’s associate, Razak Baginda but left many questions unanswered such as the obvious lack of motivation of the two killers.
The Altantuya affair will leave a long lasting impact in the minds of voters who are not convinced that all has been revealed or that justice has been done. It leaves a bad taste in the mouth that anything can be covered up in Malaysia, even murder.
No. 7 – BTN’s Racist Course
Biro Tatanegara has been conducting courses for civil servants, government scholarship recipients and others for umpteen years but it was only in Nov 2009 that controversy exploded over the racist content of the course when the Pakatan controlled Selangor government refused to send any more participants.
Denials that the BTN course was racist were dashed by testimonies by ex-participants that the course fanned racial sentiments and sought to teach its own version of history of the country’s early years. It also badmouthed opposition leaders and inundated attendees with dire warnings of what would happen if the opposition came to power. The public is given the impression that the purpose of the BTN course is nothing more than to help BN maintain power at the expense of taxpayers. Indeed, opposition stalwart Lim Kit Siang revealed that the government spends more on BTN courses than it spends to run parliament.
Isn’t this rich coming from a body directly under the office of the prime minister who has been aggressively promoting his 1Malaysia? Calls to scrap the course have only met with vague promises of “refinements”. Abdullah Badawi was kicked out by voters for not keeping his promise of anti-corruption; Najib Razak may be kicked out for giving the people false hopes of racial integration and fairness.
No. 6 – PKFZ Scandal
Financial scandals are nothing new to BN. The Auditor-General’s report of profligate bleeding of the public purse and common items purchased at breathtaking prices makes its round with monotonous regularity every year. We hear of Khir Toyo’s fabulous mansion which must be beyond the means of a mere ex-Mentri Besar and the RM10 million transfer to London by another Mentri Besar with a shrug and a sigh. Will things ever change?
But the sheer size of the financial shenanigan of the Port Klang Free Zone project makes even the jaded Malaysian gape in anger. A PriceWaterhouse-Cooper report said that potential losses could reach RM12.5 billion, a staggering amount for a small developing country. For all that only a few small fishes have been charged, the highest being the ex-general manager of Port Klang Authority. What about the big sharks including the ex- transport ministers who signed the illegal letters of guarantee? How about going after the owner of the Contractor who laughed all the way to the bank instead of his employees?
The public is not impressed with such tokenism. PKFZ will continue to dog BN as the hallmark of its plundering ways with the real sharks getting to enjoy their ill gotten gains with impunity.
No. 5 – Teoh Beng Hock’s Death
A DAP political aide went voluntarily to MACC’s office in Shah Alam to be questioned as a witness over a RM2400 allegation involving his boss and left through the window of the 14th floor in the early hours of the morning, his bruised body cold and lifeless. The senseless death of a young man who was only days away from getting married and had an unborn child shocked and outraged Malaysians who demanded that the culprits be brought to justice.
But justice in Malaysia can take a long winding road and be completely sidetracked at times. MACC denied responsibility and claimed Teoh had been released although his hand phone, wallet and car keys were still in their custody. Why was he relentlessly interrogated throughout the night over such a trivial case? Lengthy police investigation of this open and shut case drew an incredulous blank.
During the inquest, two government pathologists took medical leave at the same time. When they returned they sang a duet to try to convince the public of suicide although the lack of motivation is clear. A Thai expert appointed by the Selangor government testified that there is an 80% chance of homicide and pointed to injuries which are unlikely to be due to a fall including contusions on the neck, bruises on the thighs and a punctured anus. A second post mortem was held in the presence of foreign experts but a third government pathologist sang the same implausible tune of suicide.
The inquest has not been concluded but it is not difficult to guess which way the verdict is being guided to. BN can avoid serious political fallout by dispensing justice but is that likely? After all, the public are gullible fools who can be lied to with impunity can’t they?
No. 4 – The Perak Power Grab
In Perak democracy has been physically and psychologically shred to pieces with the power grab by Umno with the help of three morally tainted party hoppers. Two of the political frogs were facing corruption charges and there was a strong stench of corruption and coercion involved.
Despite widespread calls for new state elections to return the mandate to the people, Umno is genuinely puzzled why it should hold election when it already controls the state legislature, albeit by a narrow margin. The power grab was backed up with the physical force of the police and enforced by controversial court judgements which blurred the doctrine of separation of powers and the distinction between a constitutional and absolute monarchy. In a shameful act, police entered the Assembly to drag the legal Speaker Sivakumar from his chair to allow BN to install an improperly elected Speaker.
The Perak power grab will forever be remembered as an immoral and reprehensible act by Umno to whom democracy is just lip service and power is all that matters irrespective of how it is obtained and kept. In a nutshell this describes Umno perfectly.
No. 3 - Buying of PKR Elected Representatives
Instead of respecting the choice of the people Umno has never stopped attacking and trying to de-stabilize PR in any way possible including luring elected representatives to defect using the carrot ($$$) and the stick (MACC trumped up charges). In a vile attempt to regain its 2/3 majority in parliament to gerrymander constituencies a war chest of RM50 million of corruption money was set aside to buy opposition members of parliament.
Regrettably three PKR MPs succumbed to BN’s contemptible temptation. These MPs have ended their political careers but as they have probably collected more than they can earn in two lifetimes this could be the least of their worries. Yes, PKR should have fielded better quality candidates but in 2008 few good candidates wanted to stand under the banner of what they perceive as a sure loser. Hence low quality candidates were fielded in seats where they were not expected to win. But win they did and caused all the problems.
The public is intelligent enough to disregard the shallow reasons given by the defectors and zero in on the real reason – money and lot’s of it. They will punish BN at the next election for subverting democracy. This cleaning out of refuse from the party will in fact make PKR stronger.
One may be tempted to compare Anwar’s Sept 16 bid to topple the Federal government by defections and BN’s despicable acts. First of all, two wrongs do not make a right. Secondly, Anwar was appealing for good people to defect on principles to build a better Malaysia and not by dangling millions in front of them. Thirdly, Anwar pledged to hold snap elections after the BN government had been toppled. Lastly, Sept 16 did not happen.
No. 2 – The Allah Controversy
If ever there is a self-inflicted political disaster, this is it. For decades and even before the formation of Malaysia the Christians in East Malaysia had been using Allah for the name of God. No Muslim has objected or become confused; indeed there is a historical basis that Allah is not exclusive to Islam and is also used by many other faiths around the world.
Enter the gung-ho Home Ministry who decreed that Allah can only be used by Muslims and banned the Catholic Church from using the term in their internally circulated newsletter. The Church took the matter to court and won a High Court judgement lifting the Home Ministry’s ban. Umno leaders took it badly and criticized the court judgement roundly. Tacit approval was given for demonstrations by supposedly enraged Muslims. It turned out to be an ill attended tame affair.
What happens next shows that playing with religious sentiment is as risky as playing with fire. A church in Petaling Jaya was burnt down and eleven others attacked. When these failed to elicit any counter response boar heads were found at two Muslim places of worship.
The attacks on the churches brought condemnation from around the world and much bad publicity for Malaysia whose reputation as a moderate Muslim nation was in tatters. Umno was given a hefty slap when PAS stood with its allies and said that Allah is permitted to be used by other faiths.
The roles of the two Malay parties have been reversed. PAS which was once perceived as extremist is now seen as more centrist than Umno which is now perceived as pandering to extremists. The caning of three Malay women has not helped Umno’s image. What a boost for Pakatan Rakyat trying to win over middle Malaysia!
No. 1 – Sodomy II
Make no mistake, this is the numero uno, the number one in BN’s self-inflicted political disasters. In this day and age, an educated and literate population will witness an opposition leader dragged to court on transparently trumped-up charges and in all probability convicted. If you think sham trials were over with Stalin and Hitler or are the domain of brutal military regimes like Burma and North Korea, welcome to Malaysia.
The charge of consensual sodomy itself reeks of political persecution when the government has never been interested in enforcing this archaic piece of legislation against practicing homosexuals. Yet Anwar is charged with consensual sodomy while his alleged consensual partner has become the “victim” on whose behalf the whole apparatus of the Malaysian government is seeking justice.
The government saw fit to proceed with this dubious case despite two medical reports by one private doctor and 3 government specialists that there is no evidence of penetration on the accuser. Perhaps we will be the only country in the world to convict a man of rape when the “victim” is a medically certified virgin. Zimbabwe, watch and learn!
Even before the inevitable conclusion of Anwar’s trial, Malaysia has become the whipping boy and the butt of ridicule in the international press. When it is over our judiciary will become an international laughing stock. To proceed with this ludicrous case shows BN’s incredible arrogance and lack of political sense. Not only did they dig their own graves, they brought their own shovels, not only did they hang themselves, they supplied their own rope.

No doubt in the 2 to 3 years to the next general election there will be many more scandals and controversies surfacing although they have already done enough. Given enough time, BN will do all the work to convince people it is the bigger devil so all that Pakatan Rakyat has to do is to stay as a cohesive coalition and survive BN’s relentless attacks. Of course it doesn’t hurt for PR to do the right things and give better service delivery to the people to leave no room for doubt that it is the better alternative.

The inquest has not been concluded but it is not difficult to guess which way the verdict is being guided to. BN can avoid serious political fallout by dispensing justice but is that likely? After all, the public are gullible fools who can be lied to with impunity can’t they?
No. 4 – The Perak Power Grab
In Perak democracy has been physically and psychologically shred to pieces with the power grab by Umno with the help of three morally tainted party hoppers. Two of the political frogs were facing corruption charges and there was a strong stench of corruption and coercion involved.
Despite widespread calls for new state elections to return the mandate to the people, Umno is genuinely puzzled why it should hold election when it already controls the state legislature, albeit by a narrow margin. The power grab was backed up with the physical force of the police and enforced by controversial court judgements which blurred the doctrine of separation of powers and the distinction between a constitutional and absolute monarchy. In a shameful act, police entered the Assembly to drag the legal Speaker Sivakumar from his chair to allow BN to install an improperly elected Speaker.
The Perak power grab will forever be remembered as an immoral and reprehensible act by Umno to whom democracy is just lip service and power is all that matters irrespective of how it is obtained and kept. In a nutshell this describes Umno perfectly.
No. 3 - Buying of PKR Elected Representatives
Instead of respecting the choice of the people Umno has never stopped attacking and trying to de-stabilize PR in any way possible including luring elected representatives to defect using the carrot ($$$) and the stick (MACC trumped up charges). In a vile attempt to regain its 2/3 majority in parliament to gerrymander constituencies a war chest of RM50 million of corruption money was set aside to buy opposition members of parliament.
Regrettably three PKR MPs succumbed to BN’s contemptible temptation. These MPs have ended their political careers but as they have probably collected more than they can earn in two lifetimes this could be the least of their worries. Yes, PKR should have fielded better quality candidates but in 2008 few good candidates wanted to stand under the banner of what they perceive as a sure loser. Hence low quality candidates were fielded in seats where they were not expected to win. But win they did and caused all the problems.
The public is intelligent enough to disregard the shallow reasons given by the defectors and zero in on the real reason – money and lot’s of it. They will punish BN at the next election for subverting democracy. This cleaning out of refuse from the party will in fact make PKR stronger.
One may be tempted to compare Anwar’s Sept 16 bid to topple the Federal government by defections and BN’s despicable acts. First of all, two wrongs do not make a right. Secondly, Anwar was appealing for good people to defect on principles to build a better Malaysia and not by dangling millions in front of them. Thirdly, Anwar pledged to hold snap elections after the BN government had been toppled. Lastly, Sept 16 did not happen.
No. 2 – The Allah Controversy
If ever there is a self-inflicted political disaster, this is it. For decades and even before the formation of Malaysia the Christians in East Malaysia had been using Allah for the name of God. No Muslim has objected or become confused; indeed there is a historical basis that Allah is not exclusive to Islam and is also used by many other faiths around the world.
Enter the gung-ho Home Ministry who decreed that Allah can only be used by Muslims and banned the Catholic Church from using the term in their internally circulated newsletter. The Church took the matter to court and won a High Court judgement lifting the Home Ministry’s ban. Umno leaders took it badly and criticized the court judgement roundly. Tacit approval was given for demonstrations by supposedly enraged Muslims. It turned out to be an ill attended tame affair.
What happens next shows that playing with religious sentiment is as risky as playing with fire. A church in Petaling Jaya was burnt down and eleven others attacked. When these failed to elicit any counter response boar heads were found at two Muslim places of worship.
The attacks on the churches brought condemnation from around the world and much bad publicity for Malaysia whose reputation as a moderate Muslim nation was in tatters. Umno was given a hefty slap when PAS stood with its allies and said that Allah is permitted to be used by other faiths.
The roles of the two Malay parties have been reversed. PAS which was once perceived as extremist is now seen as more centrist than Umno which is now perceived as pandering to extremists. The caning of three Malay women has not helped Umno’s image. What a boost for Pakatan Rakyat trying to win over middle Malaysia!

Make no mistake, this is the numero uno, the number one in BN’s self-inflicted political disasters. In this day and age, an educated and literate population will witness an opposition leader dragged to court on transparently trumped-up charges and in all probability convicted. If you think sham trials were over with Stalin and Hitler or are the domain of brutal military regimes like Burma and North Korea, welcome to Malaysia.

The government saw fit to proceed with this dubious case despite two medical reports by one private doctor and 3 government specialists that there is no evidence of penetration on the accuser. Perhaps we will be the only country in the world to convict a man of rape when the “victim” is a medically certified virgin. Zimbabwe, watch and learn!
Even before the inevitable conclusion of Anwar’s trial, Malaysia has become the whipping boy and the butt of ridicule in the international press. When it is over our judiciary will become an international laughing stock. To proceed with this ludicrous case shows BN’s incredible arrogance and lack of political sense. Not only did they dig their own graves, they brought their own shovels, not only did they hang themselves, they supplied their own rope.

Of course it doesn’t hurt for PR to do the right things and give better service delivery to the people to leave no room for doubt that it is the better alternative.

Saiful made many mistakes before and after the alleged act by failing to conceal his movements and being an incredibly lousy actor. Perhaps he thought playing the victim isn’t important as the powerful players behind him will take care of everything. But there’s a limit to how much idiocy the public can take. A real victim of forced sodomy or male rape does not appear smiling and waving to the press in public as if he’s damn proud of it.
It all looks like a hastily conceived, bumbling, incompetent and ill-thought out plot. So here are 40 reasons why the sodomy charge against Anwar is too ridiculous to believe.

6. Made a police report 2 days after the alleged incident. Was he waiting to see if he was pregnant?
7. Went to work as usual next day and was seen walking straight.
8. Attended a function at Anwar’s house in the evening with Anwar present and served coffee to the guests. Would a rape victim do that?
9. Sent a friendly quit e-mail to Anwar that he was resigning because he was lazy and incompetent. No mention that he couldn’t take the sodomy.
10. Show no sign of being victimized and traumatized. Smile and wave to press after he made his police report. Looks proud to be a victim of male rape.
11. Met and photographed with senior officers in DPM dept a few months before the alleged incident. Claimed to have gone there to apply scholarship but the DPM Dept is the wrong place to go for scholarship. Why all the lies?
12. Met Najib who was Deputy PM at his official residence 2 days before the alleged incident. Najib at first denied the meeting, later claimed Saiful wanted a scholarship? Is the Deputy PM so easy to access? Why would college dropout need scholarship?
13. In a final twist Najib said he advised Saiful who was traumatized to lodge a police report. But this was before the alleged act!
14. Met police office SAC Rodwan in Room 619 of Concorde Hotel Shah Alam 1 day before the alleged incident. Were they discussing scholarship?
15. Saiful’s god mother Mumtaz Jaafar is a close friend and ‘bag lady’ of Rosmah Mansor, Najib’s wife. It is widely believed that the plot was hatched by Rosmah and Najib.
16. Known to be a rabidly pro-BN while in college.
17. Went to Pusrawi hospital to get a medical examination and told the doctor that he had been sodomized by a plastic object. The doctor said he looked and behaved normally. Why didn’t he go straight to the police?
18. Went to mosque to swear that Anwar sodomized him against his will during the Permatang Pauh by-election so that BN can make political capital out of it.
19. Must be the most publicity hungry rape victim in the world, male or female, bar none!
Police & prosecution
20. Why are huge resources and manpower devoted to this case as if consensual sodomy is the most heinous crime in the country, worse than the murder of a Mongolian woman? How does an alleged consensual partner in sodomy suddenly become a victim for whom the whole apparatus of government must be marshalled to seek “justice?” Tie this with no. 2 and see if you can make any sense.
21. A copy of the police report was given to Anwar only after he had been questioned by police and after much pestering by his lawyers. Usually a suspect should be given a copy of the police report before taking his cautioned statement to prevent him unwittingly incriminating himself. Why was this procedure not followed? Did the police upset the procedure to design the charge and fabricate the police report to fit in with Anwar’s movements?
22. Why was Anwar unnecessarily held overnight in jail cell when he could have been released on the same day? The next morning he was asked a few perfuntionary questions and released. But it was revealed that his jail cell was carefully swept by forensic after his release. Were they looking for traces of his DNA?
23. Anwar was asked to give a blood sample during the medical examination but he refused. After that Umno leaders made public calls for him to give a sample. Why such a tussle to get Anwar’s blood sample with no safeguards whatsoever? In view of the fact that his blood sample had been planted on a mattress in sodomy I, why should Anwar make it so easy for them?
24. After Anwar refused to give his blood sample a new DNA Identification Bill was proposed in which the police are allowed to forcibly take blood sample from any suspect, custody of DNA samples will be managed by the police, the accuracy of DNA evidence cannot be challenged and the judge must consider DNA evidence to be conclusive. The Home Ministry wanted to rush this bill through parliament. Do you smell a rat here? Thankfully this DNA Identification Bill has not been passed into law yet after much opposition.
25. The prosecution fought tooth and nail to transfer the case from the Sessions Court to High Court without giving any creditable reason. If they have real evidence they could have convicted Anwar in any court under any judge so why the lengthy fight to transfer the case as if their whole case depends on who hears it?
26. The prosecution also fought all the way to the Federal Court to deny giving Anwar document necessary for his defence according to the Criminal Procedure Code, not even most basic list of witnesses. Why such unbecoming and sordid loser behaviour if they have a real case with real evidence?
27. In any sexual offence where penetration is a crucial factor no prosecutor will proceed without favourable medical evidence. In this case the prosecution decided to proceed with unfavourable medical evidence (see no.28 & 29). Were they depending on a compliant judge? (see no. 25)
Medical
28. A medical report by Dr. Mohamed Osman of Pusrawi Medical Centre, a Burmese expatriate doctor with 30 years experience certified that Saiful asshole had never been penetrated.
29. A separate medical report by 3 specialists at Hospital KL also confirmed that Saiful is an anal virgin.
30. The prosecution claimed that they have DNA sample extracted from Saiful’s rectum which incriminate Anwar but experts say that this environment is very hostile to semen and prone to contamination. It is unlikely that any usable DNA can be found after 2 days.
31. The prosecution refused to give Anwar a DNA sample for independent verification so any claim of positive identification is just the word of the government chemist against his.
32. The prosecution cannot prove that the DNA sample in question was actually extracted from Saiful’s rectum although they claim it.
33. The possibility exists that any DNA sample may have been spiked with Anwar’s DNA collected covertly. (see no. 22 and 23)
Anwar’s Personal Life
34. Anwar is 63 year old grandfather with 6 children and a loving wife. Would a homosexual person father 6 children and have a close relationship with his wife?
35. If Anwar’s sexual inclination is true then where are the other partners? Why has nobody come out of the woodwork to claim a relationship with him? Anwar’s associates who were convicted of sodomy with him all repudiated their confessions as extracted under torture the moment they were released.
36. Anwar had just led the opposition to stunning gains at the Mach 2008 polls and was plotting to take over the Federal government by engineering defections. Why would Anwar risk everything for this college dropout? If indeed his lust is so great, ther must be many others so where are the other partners?

I have stayed in this country for the past 59 years. I have mixed with Malays Chinese and Indians and my relationship with all the races is extremely cordial. Therefore I do not see any threat that the non malays can give to the Malays. EX-JUDGE JUDGING THE JUDGES
In his latest scathing critique, he said the rakyat is “stunned by the ignorance of our judges of the highest court in the land”, as seen in the recent Federal Court’s decision not to review Anwar Ibrahim’s application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial.

The integrity of the judiciary has been badly mauled by a legal lion who does not mince his words no matter how high or mighty a judge thinks he is. He has called a spade a spade and certain members of the judiciary an “incompetent” and even an “idiotic” bunch!
All the Chief Justice (CJ) and the judges in the Palace of Justice have managed to do is remain mum, mute and mumble amongst themselves as N H Chan methodically makes them out for who they really are and the mockery they have made of the law!
The respected, renowned and retired Justice N H Chan is very frustrated, fed-up and furious at how the judiciary which he had served so faithfully has been reduced to a farce run by those who are legal and intellectual frauds or what he has called “imposters”!
With each passing compromised judgment N H Chan unhesitatingly hits out at judges with an increasingly sharper sting. He leaves no stone unturned, no errant judge uncovered. They can “no longer mask their hyperbole judgments with unintelligible garbage”.
“Fools on the bench”
In his latest scathing critique, he said the rakyat is “stunned by the ignorance of our judges of the highest court in the land”, as seen in the recent Federal Court’s decision not to review Anwar Ibrahim’s application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial.
N H Chan said the Federal Court’s approach to Rule 137 of the Rules of the Federal Court 1995 was “inconsistent” and “dishonest” and “those ignoramuses” were talking “utter nonsense”. Those “inane judges cannot even understand plain English”! He put it very plainly and painfully!
Calling the three-member panel of Justice Zulkefli Ahmad Makinuddin, Mohd Ghazali Mohd Yusoff and Heliliah Mohd Yusof “incompetent”, he added “perhaps they were clowns as their statements were laughable”.
His searing criticism was that they “…do not know justice from injustice”, and that “such lowly individuals should never be allowed to sit on the seat of Justice…(and) to be judges at all. And yet there are so many of them in the judiciary today ever since the rot begun.”
He shredded into smithereens the “judicial renaissance” of the CJ: “Our country does not need impostors, who pose as judges, to deceive the common people any longer. The common citizenry can now uncover the impostors hiding beneath the mantle of the judicature.”
He laid bare the judicial sham: “With judges such as these in the Malaysian judiciary where, to them, the principles of the law are not to be consonant with justice to be manipulated by them to uphold injustice, it is no wonder that the errant judges have forfeited the confidence of the people. ”
He left them with a stinging slap in the face: “The general public does not respect such judges anymore! They have put themselves beyond the pale. Just like pariahs. Don’t you think they should be despised?”
On High Court judge Justice Mohamad Zabidin Mohd Diah’s rejection of Anwar’s application to have the judge recuse himself from further hearing the sodomy trial, N H Chan said that the judge was talking “utter nonsense” and “knew next to nothing about judicial bias”.
He added that the “moral of this unsavoury episode” is this: if you appoint mediocre lawyers to the Bench you will get substandard judges. The solution to this problem is a simple one. Appoint judges from the cream of the legal profession and you will not find me assailing the judges for incompetence simply because I will not be able to do so.”
Such was his cutting conclusion: “It is only when we have fools on the bench that I can point out that what they have decided is not the law.”
“Bunch of idiots in high places”
N H Chan had not spared the judges in the cases related to the Perak constitutional crisis of his very strong language when scrutinising their decisions (with the exception of Kuala Lumpur High Court Justice Abdul Aziz Abdul Rahim whom he had praised).
He highlighted the “bad” and “perverse” judgments, especially those in the appellate courts, the collective written judgements which were “riddled with contradictions” and how the Perak and Federal Constitutions were toyed with and trampled on by the judges!
During the Perak debacle N H Chan had said that there are “many of our judges today especially among those judges in the higher echelon of the judicial hierarchy who do not seem to know the true meaning of separation of powers in constitutional law. This is most apparent.”
He called some of the judges of the cases of the Perak imbroglio:
a) Bad judges – they “seem to think that independence means that they can do what they like”
b) Recalcitrant judges – “they think that words can mean whatever they want them to mean”
c) Humpty Dumpty judges – “they also think that they are independent of the legislature”.
N H Chan has brought to light how beholden the judiciary is to the Umno-dominated Government. He said the “so-called Perak crisis has brought out a host of cases that showed that the judges gave the impression that they were one-sided. The perception of the people is that they sided with the BN government.”
In the “shocking case” of Zambry v Sivakumar in the Federal Court, he called the judgment by the “infamous five” (judges) Alauddin Mohd Sheriff , Arifin Zakaria, Nik Hashim Ab Rahman, Augustine Paul and Ahmad Makinnuddin, a “perverse decision”.
In the case of Nizar vs Zambry he called the panel of five Federal Court judges made up of the President of the Court of Appeal Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria, Zulkefli Ahmad Makinuddin, Ghazali Mohd Yusoff and Abdul Hamid Embong, “myopic judges”.
They “were lost in a quagmire of confused thinking caused by their own incompetence. They found themselves deep in the forest unable to see the wood for the trees. Does this mean that we have a bunch of incompetent judges who sit in the highest court in the land?”
Alas, with the help of N H Chan the public especially those in Perak were able to see for themselves how members of the judiciary had left behind a dead constitution, “bad” and “perverse” decisions, dubious declaratory orders, judgments devoid of reasoned grounds, and disgraceful double standards.
Blind and Biased Judges
N H Chan has “judged the judges”. He considers them, especially those in the appellate courts’ “ignorant”, “inane”, “incompetent” and even “idiots” (which he has strongly inferred).
The public shares his view. In their eyes the judiciary has allowed itself to be intimidated, its independence and impartiality interfered with, and its integrity reduced to ignominy.
In the light of the severe criticism of N H Chan of the judiciary (which is quite unprecedented by a retired judge), surely the Chief Justice cannot stand idly, silently and stoically by – unless Zaki Azmi strenuously, staunchly and solemnly agrees with him!
Further if Zaki continues to remain silent the public will assume that he shares N H Chan's searing criticism of the judiciary. Logically he would have to resign for he has allowed the reputation of the judiciary to be sullied irreparably.
The judicial shenanigans whom N H Chan has criticized and castigated should also resign for having shamelessly sacrificed justice on the altar of political expediency.
N H Chan’s comments on members of the judiciary have no doubt been bold, blunt and blistering. He has accused judges of being blind, biased and being a bunch of “idiots” and “fools”. He has thrown the gauntlet down.
If the CJ disagrees with N H Chan’s criticisms he should haul the former Court of Appeal judge into court and demand that the latter shows cause for why he should not be cited for contempt! Does Zaki have the guts to take up the gauntlet or will he prefer to allow the judicial circus to go on?
N H Chan has made no bones about it. His blitzkrieg on the judiciary will continue. “Bad guys” had better beware! He will ensure that their names remain in infamy for generations to come unless they recant the wrongs that they have done! He will even write their obituary and if they outlive him there will be others who will take his place!
N H Chan sees the next general elections as the only solution to an unsalvageable judiciary viewed by the public with greater suspicion, skepticism and even scorn. He once commented: “At the present time and judging by what we have experienced so far from the Perak takeover cases, the quality of most of our judges is suspect”.
“In the meantime what should we do with so many bad apples in the barrel? If only there could be a change in government in the next general elections with the opposition winning by a landslide. Then we could get rid of all the bad apples by Act of Parliament.”

No, justice Chan should not join any political party so that he can air his views without bias and with impartiality and not bound by party rules so that the truth be always revealed! Just like our beloved Pete, it is better for justice Chan to be an activist. If and when Pakatan marches into Putrajaya, we, the rakyat will positively endorse him to be our CJ if not our legal consultant to tap his vast knowledege and wealth of experience at both ends of the legal profession.

And going through the the sun paper CJ Alauddin stated that mamak has the authority under the federal constitution to sack his cabinet minister. FURTHUR he sAID I quote " THE KING as a constitutuonal monarch was requird to act in accordnce with the advice of the prime minister.Good so far. However how come the judges in the Perak case of Nizar did not apply the same logic i.e that the sultan follow the advice of the MB. Now we have two laws one for the agong and another for the sultans. Please MR JUDges don't think the man in the street are fools. ONE LAW for BN and another for PKR. You judges are a disgrace to this nation and me an ordinary rakyaat can see the difference. You CJ and the rest of your monkeys on the bench will have to answer for all th foolish and incompetent judgements yr dishing out to please yr masters in BN. The integrity of the judiciary has been badly mauled by a legal lion who does not mince his words no matter how high or mighty a judge thinks he is. He has called a spade a spade and certain members of the judiciary an “incompetent” and even an “idiotic” bunch!
All the Chief Justice (CJ) and the judges in the Palace of Justice have managed to do is remain mum, mute and mumble amongst themselves as N H Chan methodically makes them out for who they really are and the mockery they have made of the law!
The respected, renowned and retired Justice N H Chan is very frustrated, fed-up and furious at how the judiciary which he had served so faithfully has been reduced to a farce run by those who are legal and intellectual frauds or what he has called “imposters”!
With each passing compromised judgment N H Chan unhesitatingly hits out at judges with an increasingly sharper sting. He leaves no stone unturned, no errant judge uncovered. They can “no longer mask their hyperbole judgments with unintelligible garbage”.
“Fools on the bench”
In his latest scathing critique, he said the rakyat is “stunned by the ignorance of our judges of the highest court in the land”, as seen in the recent Federal Court’s decision not to review Anwar Ibrahim’s application to review its previous decision dismissing his application for disclosure of documents for his second sodomy trial.
N H Chan said the Federal Court’s approach to Rule 137 of the Rules of the Federal Court 1995 was “inconsistent” and “dishonest” and “those ignoramuses” were talking “utter nonsense”. Those “inane judges cannot even understand plain English”! He put it very plainly and painfully!
Calling the three-member panel of Justice Zulkefli Ahmad Makinuddin, Mohd Ghazali Mohd Yusoff and Heliliah Mohd Yusof “incompetent”, he added “perhaps they were clowns as their statements were laughable”.
His searing criticism was that they “…do not know justice from injustice”, and that “such lowly individuals should never be allowed to sit on the seat of Justice…(and) to be judges at all. And yet there are so many of them in the judiciary today ever since the rot begun.”
He shredded into smithereens the “judicial renaissance” of the CJ: “Our country does not need impostors, who pose as judges, to deceive the common people any longer. The common citizenry can now uncover the impostors hiding beneath the mantle of the judicature.”
He laid bare the judicial sham: “With judges such as these in the Malaysian judiciary where, to them, the principles of the law are not to be consonant with justice to be manipulated by them to uphold injustice, it is no wonder that the errant judges have forfeited the confidence of the people. ”
He left them with a stinging slap in the face: “The general public does not respect such judges anymore! They have put themselves beyond the pale. Just like pariahs. Don’t you think they should be despised?”
On High Court judge Justice Mohamad Zabidin Mohd Diah’s rejection of Anwar’s application to have the judge recuse himself from further hearing the sodomy trial, N H Chan said that the judge was talking “utter nonsense” and “knew next to nothing about judicial bias”.
He added that the “moral of this unsavoury episode” is this: if you appoint mediocre lawyers to the Bench you will get substandard judges. The solution to this problem is a simple one. Appoint judges from the cream of the legal profession and you will not find me assailing the judges for incompetence simply because I will not be able to do so.”
Such was his cutting conclusion: “It is only when we have fools on the bench that I can point out that what they have decided is not the law.”
“Bunch of idiots in high places”
N H Chan had not spared the judges in the cases related to the Perak constitutional crisis of his very strong language when scrutinising their decisions (with the exception of Kuala Lumpur High Court Justice Abdul Aziz Abdul Rahim whom he had praised).
He highlighted the “bad” and “perverse” judgments, especially those in the appellate courts, the collective written judgements which were “riddled with contradictions” and how the Perak and Federal Constitutions were toyed with and trampled on by the judges!
During the Perak debacle N H Chan had said that there are “many of our judges today especially among those judges in the higher echelon of the judicial hierarchy who do not seem to know the true meaning of separation of powers in constitutional law. This is most apparent.”
He called some of the judges of the cases of the Perak imbroglio:
a) Bad judges – they “seem to think that independence means that they can do what they like”
b) Recalcitrant judges – “they think that words can mean whatever they want them to mean”
c) Humpty Dumpty judges – “they also think that they are independent of the legislature”.
N H Chan has brought to light how beholden the judiciary is to the Umno-dominated Government. He said the “so-called Perak crisis has brought out a host of cases that showed that the judges gave the impression that they were one-sided. The perception of the people is that they sided with the BN government.”
In the “shocking case” of Zambry v Sivakumar in the Federal Court, he called the judgment by the “infamous five” (judges) Alauddin Mohd Sheriff , Arifin Zakaria, Nik Hashim Ab Rahman, Augustine Paul and Ahmad Makinnuddin, a “perverse decision”.
In the case of Nizar vs Zambry he called the panel of five Federal Court judges made up of the President of the Court of Appeal Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria, Zulkefli Ahmad Makinuddin, Ghazali Mohd Yusoff and Abdul Hamid Embong, “myopic judges”.
They “were lost in a quagmire of confused thinking caused by their own incompetence. They found themselves deep in the forest unable to see the wood for the trees. Does this mean that we have a bunch of incompetent judges who sit in the highest court in the land?”
Alas, with the help of N H Chan the public especially those in Perak were able to see for themselves how members of the judiciary had left behind a dead constitution, “bad” and “perverse” decisions, dubious declaratory orders, judgments devoid of reasoned grounds, and disgraceful double standards.
Blind and Biased Judges
N H Chan has “judged the judges”. He considers them, especially those in the appellate courts’ “ignorant”, “inane”, “incompetent” and even “idiots” (which he has strongly inferred).
The public shares his view. In their eyes the judiciary has allowed itself to be intimidated, its independence and impartiality interfered with, and its integrity reduced to ignominy.
In the light of the severe criticism of N H Chan of the judiciary (which is quite unprecedented by a retired judge), surely the Chief Justice cannot stand idly, silently and stoically by – unless Zaki Azmi strenuously, staunchly and solemnly agrees with him!
Further if Zaki continues to remain silent the public will assume that he shares N H Chan's searing criticism of the judiciary. Logically he would have to resign for he has allowed the reputation of the judiciary to be sullied irreparably.
The judicial shenanigans whom N H Chan has criticized and castigated should also resign for having shamelessly sacrificed justice on the altar of political expediency.
N H Chan’s comments on members of the judiciary have no doubt been bold, blunt and blistering. He has accused judges of being blind, biased and being a bunch of “idiots” and “fools”. He has thrown the gauntlet down.
If the CJ disagrees with N H Chan’s criticisms he should haul the former Court of Appeal judge into court and demand that the latter shows cause for why he should not be cited for contempt! Does Zaki have the guts to take up the gauntlet or will he prefer to allow the judicial circus to go on?
N H Chan has made no bones about it. His blitzkrieg on the judiciary will continue. “Bad guys” had better beware! He will ensure that their names remain in infamy for generations to come unless they recant the wrongs that they have done! He will even write their obituary and if they outlive him there will be others who will take his place!
N H Chan sees the next general elections as the only solution to an unsalvageable judiciary viewed by the public with greater suspicion, skepticism and even scorn. He once commented: “At the present time and judging by what we have experienced so far from the Perak takeover cases, the quality of most of our judges is suspect”.
“In the meantime what should we do with so many bad apples in the barrel? If only there could be a change in government in the next general elections with the opposition winning by a landslide. Then we could get rid of all the bad apples by Act of Parliament.”

Remember the sort of justice system we have, remember we are indeed another Zimbabwe, so if the UMNOputras so want, Justice NH Chan can indeed be thrown into their dungeons!!
But, i salute you, Mr Justice Chan[does not matter that u are retired, u deserve this most noble of addressing unless those many sitting imbeciles on the bench]!!
U can enjoy ur retirement in comfort but u have chosen to lock horns with the UMNOputras in this area where their hypocrisy are torn to pieces by your legal knowledge and justice applied judiciously.

No, justice Chan should not join any political party so that he can air his views without bias and with impartiality and not bound by party rules so that the truth be always revealed! Just like our beloved Pete, it is better for justice Chan to be an activist. If and when Pakatan marches into Putrajaya, we, the rakyat will positively endorse him to be our CJ if not our legal consultant to tap his vast knowledege and wealth of experience at both ends of the legal profession.
Malaysia needs more of brave and upright people with calibre like our beloved and highly respected justice. God Bless you!

Clowns they very likely are, haha. Incompetent, inane, inconsistent and dishonest similarly likely too. They don't expect too much from their Judiciary after all. And government in general don't care two hoots and even if any do, all that may be quite a bit over their heads.
But it can't be that the judges cannot understand plain English! Heck, how did they become judges of the highest order? How? At least one of them was one time the Solicitor General who studied in an English school in Ipoh and went on to the law Mecca (oops, better withdraw that) that law apex of London.
Don't know plain English? Nah. Nothing to do with language abilities, Nothing to do with knowing the law.
It's all about USING the law. Yes, sadly they do not know justice from injustice and that's all embedded in their hearts and conscience.

The reason our judges behave the way they do is because the mainstream media will never report about their travesty of justice like what the media in other countries would do. The people in our judiciary can still go to sleep soundly as the next day our MSM will not comment on their assine and disgusting deeds. If in another country the independent media would tear the partial judges to pieces. Same thing with would be done to the politicians and enforcement officials. Tonight they will worry and can't even get a minutes sleep wondering what the media will say about them tomorrow morning. That does not happen to the unrepentant in Boleh Land. They sleep to the lullaby of non-reporting by the biased mainstream media.

Bravo, for making the bold move to call a spade a spade without mincing your words. . Nobody in authority in your field of expertise has done that in the past. The frequent hue and cry from the general public always fall on deaf ears. But , confident, it will not be so this time.

The judges are not just fools but greedy fools. Everything they are doing for UMNO is so that they can keep their jobs or even be promoted. Any trial that has something to do with the Government is just a circus to show that justice has been done. All Malaysians know this by now and the rest of the world is also finding out.
